This Privacy Policy explains how Kinder Learning Centres (“Kinder Learning“, “we“, “our“, “us“) collects, uses, discloses, and protects personal information when you visit kinderlearning.ca (the “Site“), contact us, use our online forms or chat assistant, interact with us on social media, or enroll a child in our programs at our Ontario locations (including Oshawa).

Important: This Policy is intended to meet our obligations under Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and, where we handle personal health information (for example, allergy, medication or immunization details), Ontario’s Personal Health Information Protection Act (PHIPA). It also reflects Canada’s Anti‑Spam Legislation (CASL) for electronic communications.

What personal information we collect

We collect the following categories of information:

1) Parent/guardian information

  • Name, relationship to the child, address, email, phone number(s).
  • Enrollment and billing details (e.g., fee plan, payment method token from our payment processor), emergency contacts, authorized pick‑ups.

2) Child information

  • Name, date of birth, program/class, attendance records.
  • Information necessary for care and safety (e.g., dietary restrictions, allergies, medications, immunization status) and any individualized care instructions.
  • Photos or videos taken at our centres only with a signed media consent form.

3) Communications & support

  • Messages you send us by email, phone, website forms, and the on‑site Chat Assistant (e.g., Oshawa Campus Assistant).
  • Phone recordings/voicemail where applicable, and your preferences (tour date, program interest, waitlist status).

4) Website & device information

  • IP address, browser type, device identifiers, pages viewed, referring URL, approximate location, and date/time of visits.
  • Cookie and pixel data used for site functionality, analytics, and—if you consent—advertising/remarketing.

5) Social media

  • If you interact with our Facebook Page/Group or view embedded content on our Site, the platform may collect data under its own privacy policy. We may see aggregated insights and public profile information you choose to share.

We collect information directly from you (e.g., forms you submit), from your child’s other parent/guardian or authorized contacts, from service providers (e.g., payment, scheduling or childcare management systems), and—as permitted by law—from regulators for licensing and compliance.


How we use personal information

We use personal information to:

  • Provide childcare and school‑age programs, including enrollment, billing, attendance, and daily care.
  • Protect health & safety (e.g., allergy/medication administration according to your instructions), meet licensing and record‑keeping requirements, and respond to incidents.
  • Communicate with you about tours, enrollment, updates, policies, closures, fees, and child progress.
  • Operate and improve our Site and services (including troubleshooting, analytics, and quality assurance for the Chat Assistant).
  • With your consent: send newsletters, waitlist updates, promotions, or event notices (you may unsubscribe at any time).

We will not collect, use, or disclose personal information for purposes other than those identified at the time of collection, except with consent or as required/permitted by law.


Our legal basis / consent

We generally rely on consent (express or implied) to collect, use and disclose personal information, except where otherwise permitted/required by law. You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. If you withdraw consent, we may be unable to provide certain services (e.g., enrollment).

Where we handle personal health information (PHI), we do so in accordance with PHIPA, including obtaining the appropriate consent from a parent/guardian for a child.

For commercial electronic messages (email/text marketing), we obtain consent and include unsubscribe mechanisms to comply with CASL.


Cookies, analytics, and ads

We use necessary cookies to make the Site work and, with consent, optional cookies/pixels for:

  • Analytics (e.g., Google Analytics) to understand Site usage and improve content.
  • Advertising/remarketing (e.g., Meta/Facebook Pixel) to show ads to visitors with similar interests.

You can manage cookies through your browser settings. Some browsers offer Global Privacy Control or similar signals; we will treat these as a request to limit non‑essential tracking where feasible. If you block or disable cookies, parts of the Site may not function.

We may link to or embed third‑party content (e.g., Facebook Page/Group posts). Those services operate under their own privacy policies. We do not control third‑party tracking once you leave our Site or interact with embedded elements.


When we share information

We do not sell personal information. We may share information:

  • Service providers/agents that help us operate (e.g., payment processors; email and SMS vendors; website hosting and analytics; scheduling/waitlist; childcare management systems). These providers are bound by contractual confidentiality and security obligations and may only use data to perform services for us.

  • Legal: to comply with law, respond to lawful requests, protect our rights, safety, or property, or in a corporate transaction (e.g., reorganization), subject to appropriate safeguards.

Some providers may store or access information outside Canada (e.g., the United States). We take steps to ensure a comparable level of protection through contracts and safeguards, but information may be subject to foreign laws.


Retention

We retain records only as long as necessary to fulfill the purposes above and to meet legal, regulatory, tax and accounting requirements. Childcare and health/safety records may have specific minimum retention periods under Ontario regulations. When no longer required, we securely destroy or de‑identify information.


Safeguards

We use administrative, technical and physical safeguards appropriate to the sensitivity of the information, including role‑based access, staff training, encryption in transit, secure configurations, and vendor due diligence. No system can be guaranteed 100% secure; please contact us immediately if you believe an account or record has been compromised.


Your privacy rights

Subject to applicable law, you may request to:

  • Access your or your child’s record and obtain a copy.
  • Correct inaccurate or incomplete information.
  • Withdraw consent to further use or disclosure (subject to legal limits).
  • Opt out of marketing emails at any time (unsubscribe link or contact us).

To exercise these rights, contact us (see below). We may need to verify your identity and relationship to the child before responding. If we cannot provide access (e.g., due to legal restrictions or another individual’s privacy), we will explain why.


Children’s privacy (online)

Our Site and Chat Assistant are intended for parents/guardians. We do not knowingly solicit personal information directly from children online. If you believe a child provided us information online without parental consent, please contact us and we will delete it.


The Chat Assistant

Our on‑site assistant (e.g., “Oshawa Campus Assistant”) is intended for general enquiries (hours, programs, fees, tours). Please do not submit sensitive health or financial details through the chat. We may review chat transcripts for quality and training. If the assistant integrates third‑party providers, they will process data on our behalf under contract.


Links and third‑party services

Our Site may link to third‑party sites (e.g., Facebook, scheduling or payment). We are not responsible for their privacy practices. Review their policies before providing your information.


International visitors

If you visit our Site from outside Canada, your information may be processed in Canada and other countries. By using the Site, you understand your information may be transferred to jurisdictions with different data protection laws.
